If your personal information was maintained on a CodeMetro database server during the April 2020 data incident, you may be entitled to benefits from this class action settlement.
In April of 2020, CodeMetro (“CodeMetro” or “Defendant”) announced it experienced a data breach, which impacted the patient information and information for employees of certain providers, and may have included confidential protected health information and personally identifiable information (together “PHI/PII”).
A settlement (“Settlement”) has been proposed regarding the Data Incident in the class action lawsuit referenced above pending in the Superior Court for the State of California, Central Division (“Action”). You may be a class member in the proposed Settlement and may be entitled to participate in the proposed Settlement.
The Superior Court for the State of California has ordered the issuance of the notice in this Action. CodeMetro denies it did anything wrong and has defended itself throughout the lawsuit. The Court has not decided who is right. Both sides have agreed to settle the dispute to avoid burdensome and costly litigation.
If the Settlement is approved and becomes final, CodeMetro will create a Settlement Fund for Settlement Class Members to submit a Claim Form. If you are a Settlement Class Members and would like to see if you qualify for a Settlement Benefit, you must complete and submit a Claim Form.
You may be eligible to receive only one of three of following benefits:
- a cash payment estimated to be in the range of $132 (California residents) or $66 (non-California residents);
- up to $250 reimbursement of certain expenses; or
- up to $3,500 reimbursement of certain losses due to fraudulent activity or unauthorized charges.
The Settlement also makes a Protection Plan (consisting of credit monitoring, dark web monitoring, and Proactive Fraud Assistance; $1,000,000 insurance coverage for reimbursement of losses attributable to the Data Incident, and Identity Theft and Fraud Resolution Services) available to Settlement Class Members whose Social Security numbers were included in the Data Incident.
